Commercial Working Group Update
The Commercial Working Group (CWG) is one of three advocacy groups run by Master Builders. Members come from a range of commercial construction companies and head contractors across the country. The CWG is a sub-committee and works alongside the Vertical Construction Leaders Group (VCLG) to improve outcomes for our members and the wider industry.
As part of our workplan, the VCLG and CWG identified the need for greater education and support around contracting for the sector. The CWG/VCLG in conjunction with Hazelton Law have been working on a Good Contracting project.
The Good Contracting project consists of three main documents:
- Principles of Good Contracting.
- Risk and NZS 3910 Guidance (including documents on risk allocation, variations and extension of time), and
- A Pre-construction Services Agreement.
The Good Contracting project has also started what will be a series of shorter information sheets/resources to be prepared as required, starting with:
- Termination for Convenience Clauses
- Extension of Time Principles and Float
- Clause 9.2 Special Conditions for NZS 3910:2023
The CWG finalised these documents at our last meeting. We are planning to publicly launch these documents at the end of July. Following this, these will be made available for members. We would like to thank the CWG, VCLG and Mark Holland from Hazelton Law for all the work they have put into this project.
The next project for the CWG/VCLG will be to review SA2017 to align with the new NZS 3910:2023. We do not expect this to be a root and branch review, but we are working closely alongside our subcontractor partners through the Specialist Trade Contractors Federation.
